Terms of Service

By confirming in written form or purchasing Programs/Products or Services by NUMARU/ SUN MEE MARTIN (*COACH*), CLIENT agrees to the following Terms:

COACH-CLIENT RELATIONSHIP

Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the Client to maximize their personal potential. Coach agrees to be committed, open, and present in this work together. Client is responsible for their own success and implementation of objectives met. By joining this coaching program, Client is committing their intention to participate to 100% of your ability, unless a health or an emergency situation arises and it’s not possible for you to be there. Coach will show up 100% for Client and expects the same from Client. Coach may revise methods or parts of the Services based on the needs of the Client. 

DISCLAIMERS

The information and processes taught in this program and coaching are real and based on research, educational training, live work with people, and personal life experience—with the best intentions and 100% commitment to supporting the Client’s success. However, Coach cannot guarantee any outcome from participating in the programs provided. The Client acknowledges that Coach is not a medical doctor, psychologist, or therapist, and her services do not substitute for therapy if needed and do not prevent, cure, or treat any mental disorder or medical disease. Client agrees that Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by Coach. Client agrees to take full risk and responsibility for their personal health, actions, and decisions during and after the program.

CONFIDENTIALITY

All parties agree to maintain a safe level of confidentiality within the coaching container and to protect the best interests of all participants as it relates to private information and any type of personal information disclosed within the coaching container. All parties agree not to disclose, reveal or make use of any confidential information or any transactions, during discussions.

CANCELLATION & RESCHEDULING POLICY

Client’s purchase of coaching packages or sessions indicates the Client’s commitment to participate in the process and follow through to its conclusion. Coach will ensure 100% commitment to Client’s success. It is to the Clients benefit to decide BEFORE purchasing any package if Coach is the right one for Client.  

Once Coach has scheduled sessions with the Client, they are considered set appointments. Coach asks Client to be committed and faithful. If any unexpected events occure and Client needs to reschedule a session, Client may do so with as much notice as possible and by providing a minimum of 24 hours notice in advance of the session and making up the session within 1month of the originally scheduled date.  Any missed or canceled sessions with less than 24 hours advance notice will be forfeited, unless any outstanding circumstances like emergency health issues, terror, climate occur.  It is important that Client prioritizes this work to receive the full benefit of the services provided by Coach. 

In the event Coach is required to reschedule a session then we shall make all reasonable attempts to provide Client with as much notice as possible and to reschedule the Session within a reasonable timeframe.

PAYMENT AND REFUND POLICY

Upon executing this Agreement, Client agrees to pay to Coach the full purchase amount. If Client selects a payment plan option, Client agrees to pay fees to the Coach according to the payment schedule set forth on Coach’s website, or otherwise provided to Client, and the payment plan selected by Client. Client shall pay for program in full.

All contracts are legally binding. In unprecedented event that the program isn’t meeting Client’s expectations, or suffers from an illness or an emergency situation of any kind, Coach and Client will work together to find a solution and the best way to proceed based on the specific circumstances at hand. This can look like: partial refund & discontinuation of the program, pausing the program, adding extra time, etc.   

INTELLECTUAL PROPERTY RIGHTS

Client receives individual use only and a single-user license for the documents (e.g. worksheets, presentation decks, audio and video files) specifically created for the Client as part of the Services. Coach maintains sole copyright, other intellectual property rights, and any other data or material used. Client shall not share, copy, distribute, disseminate, or sell any materials provided and/or any login information for either commercial or non-commercial purposes provided. 

GOOD FAITH

Each party represents and warrants to the other that such party has acted in good faith and agrees to continue to so act in the execution, delivery, or termination of this Agreement.

The European commission provides a platform for online dispute resolution (OS) which is accessible at https://ec.europa.eu/consumers/odr. Consumers may use this platform for the settlement of their disputes. We are in principle prepared to participate in an extrajudicial arbitration proceeding.

ENTIRE AGREEMENT 

This Agreement contains the entire agreement between the parties and supersedes all prior agreements between the parties, whether written or oral.
